Family of woman thrown from truck near St. Joe sues for wrongful death

On Jan. 21, a 46-year-old Missouri woman was found by passing motorists lying on the side of Interstate 29 near St. Joseph. She was seriously injured. She subsequently died from her injuries at a hospital.

Police believe the woman had been pushed out of a semi truck by its driver, who then left the scene of the accident. The trucker was arrested and charged with involuntary manslaughter. He has also been sued by the victim's family for wrongful death. The trucking company where he worked and the bar where the two met that night are also listed in the civil lawsuit.

While the details of what happened on that January night are sparse, one chapter of the tragedy closed on May 10, when the trucker admitted his guilt to a criminal charge. In a plea agreement to conclude the matter, the involuntary manslaughter charge was reduced to leaving the scene of an accident, for which he received a prison term of four years.

With the Missouri criminal proceedings now behind them, the family will likely focus on the pending wrongful death lawsuit. The case will now proceed, armed with a criminal conviction to offer as evidence of negligent or willful conduct on the part of the truck driver. While it remains to be seen what the result of the family's claim will be, it is hoped they can find peace and justice as they press their plea for full accountability against those they deem to have acted negligently in a manner that caused or contributed to the wanton death of their loved one.
