Man could face wrongful death suit from hit and run accident

A hit and run accident that happened in early July has turned deadly. The man who was responsible for the Missouri accident faces criminal charges related to the incident. Now that the victim has passed away, there may be cause for the family to file a wrongful death suit in a state civil court.

The accident occurred as the 52-year-old man was hit and then left on the roadway. He was flown to the hospital by helicopter and treated for brain and spinal injuries. He died from his injuries in the hospital around two weeks after the crash.

The man who hit him fled the scene. However, police received a tip and located a vehicle they believed was involved. They found damage that was allegedly consistent with the crash. The 22-year old owner of the vehicle agreed to a search and provided an alibi for the time of the accident; which later proved to be false.

The man the police arrested faces criminal charges of leaving the scene of a crash. Regardless of the criminal charges or the outcome of those charges in a Missouri criminal court, the family of the hit and run victim may be able to pursue a wrongful death suit against the driver. They may be awarded damages that could help them deal with the medical bills from their loved ones extensive stay in the hospital. Damages may also help the family deal with the funeral cost that they have incurred as a result of the driver's alleged actions.
