Rollover accident injures Columbia woman

A 29-year-old Columbia, Missouri, woman was injured recently in a rollover car accident, after she noticed another vehicle coming toward her.

As the woman turned from Cynthia Drive onto I-70 Drive Northeast on Sept. 29, she noticed another car bearing down on her and swerved to avoid impact. As a result she ended up driving in the wrong lane of traffic and slid into a ditch.

Her 1998 Chevy Blazer rolled over and ultimately came to rest on the side of the ditch. Emergency medical personnel took 15 minutes to free the woman from her vehicle. She was taken to University Hospital by ambulance, where her was unknown. Police said the woman was wearing her seatbelt and that alcohol was not a factor in the accident.

Further details of the accident were not readily available. If the driver of the vehicle that caused the woman to swerve was operating his or her car negligently, the woman could sue for her injuries and property damage even though the other car did not hit her. The law recognizes that negligent actions can cause another vehicle to crash and damages are awarded to the victim upon a proper presentation of proof.

On the other hand, if the Blazer driver is found to have negligently caused her own injuries by distracted driving or some other act, she could have been held responsible for any damages caused to others. She would then be limited to filing a claim with her own insurer for damage to her car.
