Missouri ATV rider gets in accident with pickup

Missouri residents know that distracted driving can cause an accident in the amount of time it takes to glance away from the road. Sometimes it is just to change the channel on the radio or maybe to retrieve something from the glove box. It seems like car wrecks caused by inattention are on the rise in Missouri, and it is not always immediately clear what happened. Up in Adair County, an elderly man escaped death in an accident where it is still not entirely clear what happened.

The 84-year-old Kirksville resident was operating an all-terrain vehicle, turning from a gravel road onto westbound Highway HH, five miles west of U.S. Route 63. The ATV collided with the side of a white pickup truck that was carrying a lawn mower in the truck bed. The force of the collision threw the man off the ATV. He suffered head and shoulder injuries, and his skin was torn up, though he was conscious after the incident. He was taken to University Hospital in Columbia, where his condition was not immediately known.

The truck driver, a Macon resident, was uninjured. At this point, it is not clear where the white truck was at the time the elderly man turned onto Highway HH. It is also not established that the ATV driver was on the Highway or its shoulder.

If the evidence points to the truck driver being able to prevent the accident but for a moment of distracted driving or other negligence, the victim could have legal basis to file a lawsuit. Missouri law provides for the right of accident victims to recover monetary damages against negligent or reckless drivers for the injuries sustained.
