Missouri man may be in serious trouble after car accident

When a Missouri accident results in serious injury or death, police may look into whether criminal charges should be filed against the driver who they determine was responsible for causing the wreck. Investigating whether alcohol, cell phone usage or other factors played a role may lead Missouri police to issue criminal charges that may expose the driver to potential civil and criminal consequences. A man who is alleged to have caused a three car accident was recently arrested after police say he initiated a head-on collision that killed one child and sent several others to the hospital.

The accident is believed to have occurred around 4:40 p.m. A 33-year-old man veered into the opposite lane and hit an SUV head-on. After the initial collision, another car hit the SUV. As a result of the crash, the man's 3-year-old son was killed.

Another passenger in the man's vehicle, a 22-year-old woman, was seriously injured. She was airlifted to an area hospital where her condition is unknown. Another woman and her two children, who were driving in the third car that hit the SUV, were also injured. Their conditions are not known at this time.

Although the man has been arrested, formal criminal charges have not been filed by the prosecuting attorney's office yet. In addition to the criminal charges expected as a result of this tragic car accident, there are issues of civil liability as well. Apart from the death of the driver's own young son, the other parties suffering serious injuries in the crash reserve the right to pursue claims for personal injury in Missouri courts. The father was already the subject of a child support order, though it is not clear if it was for the benefit of the son who lost his life. If so, the surviving mother of the child may ultimately elect to pursue a wrongful death claim against the man as well.
