Driver could face wrongful death suit pertaining to deadly crash

Anytime there are cars lined up at a stop light, the drivers may truly be at the mercy of the other drivers behind them. For two drivers stopped at a Missouri roadway light, the actions of a truck driver coming up behind them appear to have led to their deaths. The families of those who died retain the right to file a wrongful death lawsuit. Moreover, the truck driver is facing criminal charges for his role in the incident.

A 41-year-old man was stopped in a car at a light behind a semi-truck, and behind the car was a 65-year-old man in a pickup truck. Another truck driver approached the traffic light. Authorities say he was traveling at nearly 60 mph when he rammed into the back end of the pickup truck. Both the pickup truck and car in front of it were pushed underneath the truck stopped at the light in front of them. Both the car and pickup driver were killed at the scene and their vehicles demolished.

The 31-year-old truck driver is facing criminal charges of first degree involuntary manslaughter. Authorities say that he did not slow down before hitting the vehicles stopped at the light. An investigation also revealed that the truck driver had driven more hours in a seven day period than permitted by the U.S. Department of Transportation.

The families of the victims in this crash reserve the right to pursue civil action in a Missouri court. If the driver is found guilty of manslaughter in criminal court, proof of that conviction may prove useful in a related wrongful death action against the man and the company for whom he was working. If liability is established to the satisfaction of a civil court in our state, demands for monetary damages said to have accrued will be adjudicated.
